SETC - Tax Credit for the Self-employed

Self-Employed, Sole Proprietors, Single Member LLC, Freelancers, Gig Workers or 1099 Subcontractor

If you are self-employed:

Then you can be eligible Tax Credit/Tax Refund SETC based on:

  • ​​Missed working hours/absent from/unable to work  +  other Covid related time off  in 2020 and 2021

Due to:

  • Sickness
  • ​​​The need to claim ‘family leave’ to care for a sick person
  • ​Other Covid related reasons

* If an employer already filed for the FFCRA, an employee can not file again *** If you have W2 status, you are not regarded as self-employed **Eligibility depending on qualification and documentation available

You need to fulfill three criteria:

  • ​Self-Employed (Sole Proprietor, Single Member LLC, Freelancer, Gig Worker or 1099 Subcontractor)
  • ​Filed a Schedule C/SE of IRS Tax form 1040 in 2020/2021 on positive net income and paid self-employment tax
  • ​Have missed work due to Covid-related issues
Definitions:
*Paid sick leave” – means paid leave under the Emergency Paid Sick Leave Act.
*Expanded family and medical leave” – means paid leave under the Emergency Family and Medical Leave Expansion Act.
*SETC eligible days that occurred during the same time as unemployment benefits were received, must be excluded from the application

How to qualify:
If you were self-employed in both 2020 and 2021, and you were unable to work on-site, from home or remotely due to COVID-19, you may be eligible for the SETC. To qualify, you must meet certain criteria, some examples are mentioned below:
  • Observing a federal, state or local quarantine/ isolation order
  • Receiving COVID-19 vaccination
  • ​Recovering time from effects related to the COVID-19 vaccine
  • ​Seeking or waiting for COVID-19 test results
  • ​​​Experiencing Coronavirus symptoms and were seeking a medical diagnosis
  • ​Following recommendation by a healthcare provider to self-quarantine
  • ​​Caring for a child or other person, who was affected by a government-issued or self-quarantine restriction
  • ​​​Cared for a child whose school/daycare was closed or unavailable
What are you eligible for?
Self-employed individuals are eligible for up to $32,200 in tax credits (average $9K).
The SETC covers up to 80 hours of paid sick leave and up to 10 weeks of paid family leave.

The SETC is not a loan but a tax credit for 2020 or 2021 income taxes, and will either reduce the current amount you owe the IRS, or you will receive a check or ACH deposit, depending on your tax status.
